Terms of Service

NestBot is a Discord bot that you add to a Discord server. These terms cover your use of NestBot during its pre-launch beta. They are written plainly. By signing in and connecting a server, you agree to them. If you do not agree, do not connect a server.

1. What NestBot is right now

NestBot is a Discord bot, currently in beta and running in analysis mode only. It observes servers you connect and collects data to build and improve the product before launch. It does not moderate, ban, kick, time out, delete messages, or send messages. A later beta phase will turn moderation on; this analysis-mode phase does not moderate. Full details of what is collected are in the Security and Data Policy, which is part of these terms.

2. Who may connect a server

You may only connect a Discord server that you own or are authorized to manage (you have the Manage Server permission). By connecting it, you confirm you have the authority to allow data collection from that server and its members, and that doing so does not break Discord's terms or any rule that applies to your server. You are responsible for telling your members that the server is being analyzed if your local rules require it. During the beta you can connect up to two servers per account; disconnect one to make room for another.

3. Your data and deleting it

  • During the beta you can disconnect a server or delete your account at any time.
  • Disconnecting a server erases everything collected from it. Deleting your account erases everything collected from all servers you connected. Erasing can take up to 24 hours.
  • When the beta analysis period ends and we leave analysis mode, the data collected up to that point is retained as our training dataset and can no longer be deleted on request. Data you deleted before that cutoff is gone and is not retained.

If you do not want your data kept, delete it before the analysis period ends. We will give notice before the cutoff.

4. The beta reward

Connecting at least one server during the beta reserves a launch reward tied to your account. The amount depends on the connected server's size, measured by its real member count as reported by Discord:

  • A server with 1,500 or more members reserves 3 months of NestBot free at launch.
  • A smaller server reserves 1 month of NestBot free at launch.
  • If you connect more than one server, your reward is the highest tier among them.

Other honest conditions:

  • The member count is taken from Discord, not self-reported, so the tier reflects the server's real size.
  • If you disconnect your last server or delete your account, you leave the beta and the reward is released.
  • The reward applies at launch and assumes NestBot launches. We are a beta and do not guarantee a launch date, or that we will launch at all.
  • The reward has no cash value and is for your account only.
  • We may adjust the reward's exact terms before launch; if we do, we will not reduce what you were promised for participating.

5. Acceptable use, fraud, and abuse

By using NestBot you agree not to do any of the following. We treat each of them as a serious, material breach of these terms:

  • Faking, inflating, or manipulating data, including a server's member count, using bots, fake or purchased members, or any other trick, to claim a reward tier you are not entitled to or to distort the dataset.
  • Connecting servers you do not own or are not authorized to manage.
  • Attempting to hack, break into, overload, disrupt, or gain unauthorized access to NestBot, its bot, dashboard, database, or infrastructure.
  • Reverse engineering, decompiling, scraping, or probing the service, or attempting to extract its models, prompts, or code, except to the narrow extent the law expressly permits.
  • Using NestBot to break the law or Discord's terms.

We take this seriously, both legally and at the account level. If we believe you have done any of these, we may, at our discretion and without notice, remove the bot from your servers, forfeit any reward, permanently ban your account, and refuse you future access. Serious cases, in particular hacking, fraud, or unauthorized access, may also be reported to the relevant authorities and pursued to the fullest extent available to us, and you may be liable for the resulting losses and costs. 6. The service is provided as-is

This is beta software. It is provided as-is, without warranties of any kind. It may have bugs, change, pause, or stop. We do not guarantee it will be available, accurate, or fit for any particular purpose. We collect data on a best-effort basis and do not guarantee completeness.

7. Limitation of liability

To the maximum extent allowed by law, NestBot and its team are not liable for any indirect, incidental, or consequential damages arising from your use of the service. Because the beta is provided free of charge, our total liability to you for any claim is limited to the amount you paid us, which during the beta is zero.

8. Ending your use

You can stop anytime by disconnecting your servers and deleting your account. We may suspend or end your access if you break these terms or to protect the service. Sections that by their nature should survive (data retention after the cutoff, disclaimers, limitation of liability) continue to apply after you stop.

9. Governing law

These terms are governed by general principles of contract law. Where a mandatory consumer protection law applies to you, nothing here removes rights you have under it.

10. Changes and contact

We may update these terms. If we make a material change, we will update the date above and email registered users at the address on their account (we can only email people who gave us one). Continuing to use NestBot after a change means you accept it. Questions: nestbot [at] mhd64.dev.
